Terms & Conditions

1. ORDER CONFIRMATIONS. Quotes will not be changed to Order Confirmations without a credit card on file and signature on the Terms & Conditions (unless otherwise specified in the Special Instructions on the quote). Only once the Quote is changed to an Order Confirmation, will the items be reserved, and the Order be confirmed. All future Order revisions will be deemed confirmed once the Terms & Conditions have been signed.

2. CREDIT CARD AUTHORIZATION. By signing the Terms & Conditions, the customer authorizes Grand Event Rentals to charge the associated credit/debit card for any order balances and/or missing equipment balances due. The credit/debit card number may be taken verbally by phone, in person, and/or through electronic means. The customer understands that their card information may be saved on file for future transactions on their account.

3. CANCELLATION/SUBTRACTION/SUBSTITUTION POLICY. Once a Quote is changed to an Order

Confirmation, all cancellations/subtractions/substitutions of Tents, Tent Accessories, and Linens, must be made at least (14 days) prior to the delivery/customer pick up date. All cancellations/subtractions/substitutions of all other items must be made at least (7 days) prior to the delivery/customer pick up date. Items that are cancelled/substituted/subtracted after these specified dates will incur a restocking charge up to 100%.

4. RESTOCKING. Customer understands and acknowledges orders are prepared for delivery/customer pick up in

advance of the delivery/customer pick up date. As stated in article 3 and as part of the rental agreement, any order

cancellations, subtractions, and/or substitutions made after the above stated policy will incur a restocking charge up to 100% to the customer.

5. DELIVERY/PICK UP. Delivery is made to the closest point a delivery truck can park. Deliveries made up or down

stairs, by elevator, or to any point where extra time is involved (more than 50’ from truck parking or on

a non-cartable surface) will result in extra fees. Our service does not include set up and tear down of tables and chairs. If this service is required, arrangements should be made several days prior to delivery with a special charge quoted. If no arrangements are made and this service is desired on delivery, our driver must call for authorization.

If time permits, we will try to accommodate the customer after a price is quoted. Upon pick up, if equipment is not torn down and placed at the delivery site, there will be an additional labor and/or pickup charge if rescheduling is required.

Please Note: Chairs and/or tables are to be restacked on carts as received upon delivery. Customer is responsible for storing carts during event.

6. CLEANING. China, Glassware, and Flatware must be returned rinsed, scraped free of food, and repacked properly in containers provided or additional charges will be assessed. Items that are returned with excessive food and/or liquid inside will incur a $45/hour cleaning fee as determined by Grand Event Rentals. Special cleaning deposits may be charged on BBQ Grills and Cooking Equipment.

7. LINENS. Table linens are inspected prior to release to customer and upon receipt from customer. If there is obvious damage such as mildew, excessive stains, burns or tears, the customer will be charged the replacement cost of the linen.

Customer must return all linens dry and free of waste. Linens are to be placed in linen bag(s) provided. DO NOT ROLL UP OR PLACE WET LINENS IN ANY BAG – mildew will result.

8. LOSS, SHORTAGES, DIRTY, OR DAMAGED EQUIPMENT. Customer agrees to pay for any damage to rented

equipment regardless of cause, except reasonable wear and tear, while equipment is out of possession of Grand Event Rentals. Customer also agrees to pay a reasonable cleaning charge for all equipment returned dirty. Accrued rental charges cannot be applied against the purchase or cost of repair of damaged goods. Rental Equipment damaged beyond repair will be paid for by Customer at its Replacement Cost when rented.

9. RESERVATION POLICY. To reserve items, a 50% nonrefundable deposit is required at time of

reservation. The full payment is charged one business day prior to delivery and/or customer pick-up.

10. PERMITS AND LICENSES. Customer shall, at their own expense and prior to the installation of the equipment,

provide all necessary permits, licenses, and other consents unless Grand Event Rentals has included charges on the

confirmed order to provide any necessary permits.

11. TENT MATERIAL. All tents are subject to stretching and retracting of up to 5% of listed sizes and although all

tents have been saturated with a waterproofing compound, no tents are guaranteed to be completely waterproof and are to be considered temporary shade structures.

12. WEATHER RELATED RISKS. Customer assumes all weather-related risks involved in holding an outdoor tented

event. Grand Event Rentals will endeavor to minimize said risk, however, should the tenting become unusable due to high wind, snow, rain, flooding, extreme cold or heat, or any other factor beyond Grand Event Rentals’ control, Customer shall still be liable for payment in full of all charges.

14. UNDERGROUND UTILITIES. Customer agrees to have all underground utilities, in the vicinity of the tent/

equipment installation, clearly marked prior to the arrival of Grand Event Rentals work crews. Customer assumes full responsibility for damage to all underground utilities i.e. underground watering systems, water lines, etc.

15. COOKING/HEATING SOURCES UNDER TENTS. Customer agrees not to do any type of cooking or use a

heating source under or within a reasonable distance of the tent. Customer assumes full responsibility and costs

incurred for damage and or cleaning expense due to cooking or heating processes under or near tents. PATIO HEATERS ARE NOT PERMITTED FOR USE UNDER OR NEAR TENTS.

17. HARDWOOD FLOORS/SURFACES. Grand Event Rentals will not be held responsible for any damage which

may occur due to the placement of rental equipment on any surface including but not limited to hardwood floors, outdoor decks, concrete pads, sport courts, etc.

13. PREPARATION OF SITE. Customer agrees to have the site upon which the equipment is to be erected, free and

clear of all obstacles, natural and man-made, prior to the arrival of Grand Event Rentals work crew. Customer further agrees to have all tent area cleared for removal prior to our arrival. All non-rented equipment and decorations shall be cleared and taken from site. If Customer fails to do so, then Customer shall pay a wait time charge if driver & crew spend more than 15-minutes waiting to unload/load equipment. Wait time is $15 for every 15-minute period thereafter per crew member.

16. ELECTRIC POWER AND LIGHTING. Customer agrees to furnish Grand Event Rentals access to, and the right

to use Customer’s electrical and power source for the installation and operation of the rented equipment.

18. INSPECTION. Customer acknowledges their responsibility to inspect the equipment prior to its use and to notify Grand Event Rentals of any defects or discrepancies. If Grand Event Rentals is notified of damaged equipment or shortages prior to return of items, Grand Event Rentals will inspect the equipment to verify items were un-usable or unreceived. Refunds are based upon the inspection and are not guaranteed. If items are found to be in good and working order, no refund will be credited to the Customer.

19. REPLACEMENT OF MALFUNCTIONING EQUIPMENT. If equipment becomes unsafe and/or in disrepair for

any reason, the Customer agrees to discontinue its use and notify Grand Event Rentals immediately. Grand Event Rentals will repair or replace the equipment with similar equipment in good working order if available, and if the defect is the result of normal use. Grand Event Rentals is not responsible for any incidental or consequential damages caused by delays or otherwise, and Customer hereby waives any right or entitlement thereto. If Grand Event Rentals replaces the equipment and upon testing the original equipment, discovers that the equipment is in good working order, additional charges may occur for delivery of replacement equipment.

20. RETURN OF EQUIPMENT. At the termination of this agreement, Customer shall return all the equipment to

Grand Event Rentals’ premises during Grand Event Rentals’ posted business hours, in the condition and repair as when delivered to Customer, subject only to reasonable wear and tear. Customer shall be liable for all damages to or loss of the Equipment occurring if items were not returned within Grand Event Rentals’ regular business hours. If Grand Event Rentals has agreed to deliver the equipment to the Customer or to pick up the equipment from Customer, Customer shall be responsible for all losses or damage to the equipment from time of delivery to Customer and until picked up by Grand Event Rentals. Time is of the essence in this agreement. Any extension must, at Grand Event Rentals’ election be mutually agreed upon in writing.

21. INSPECTION BY GRAND EVENT RENTALS. Grand Event Rentals shall at all times have the right to enter any

premises where the equipment may be located for purposes of inspecting it, observing its use, or removing it from

Customer’s premise.

22. TITLE AND OWNERSHIP. The rented equipment shall at all times be and remain the sole and exclusive property

of Grand Event Rentals. Customer shall have only the rights to use the equipment in accordance with the terms of this agreement. Grand Event Rentals shall have the right to display notice of its ownership of the equipment by display of an identifying stencil, plate or other marking, and Customer agrees that it will not remove or cover such markings without the written permission of Grand Event Rentals. It is expressly intended and agreed that the equipment shall be personal property even though it may be affixed or attached to real estate. The equipment shall not be removed from the place of delivery or installation without the expressed written permission of Grand Event Rentals.

23. WARRANTIES. Grand Event Rentals is neither the manufacturer of the rented property nor the agent of the

manufacturer, and no warranty against patent or latent defects in material workmanship or capacity is given, and

Customer expressly waives all such warranties of fitness which may be accorded by law or otherwise. There are no

warranties of merchantability or fitness, either express or implied. There is no warranty that the equipment is suited for customers intended use, or that it is free from defects, and any and all such warranties of fitness, or otherwise, are expressly and specifically waived by customer.

24. HOLD HARMLESS AGREEMENT. Customer shall defend, indemnify and hold harmless Grand Event Rentals,

its employees, agents and subsidiaries, from and against all claims, liabilities, losses, damages to property or otherwise, and expenses, of every character whatsoever, resulting from the actions, negligence or otherwise, of Customer, Customer’s employees and agent of Customer or Customer subcontractor. The indemnities included in this exhibit shall include reasonable attorneys’ fees paid by Grand Event Rentals in defending suit and actions involving liability covered by the indemnification provision in this paragraph.

25. ASSIGNMENTS, SUBRENTAL AND LOANS OF EQUIPMENT. Customer may assign its right under this

contract without Grand Event Rentals’ consent, but will remain bound by all obligations herein. The Customer may not sub-rent or loan the equipment without Grand Event Rentals’ written permission. Any purported assignment by the Customer is void.

26. COMPLIANCE WITH LAW and SAFETY REGULATIONS. As Grand Event Rentals has no control over the

use of rented equipment by Customer, Customer agrees at its sole expense to comply with all municipal, county, state, and federal laws, ordinances, and regulations, including the Occupational Safety & Health Administration Act of 1970 which may affect the equipment while it is in the possession of and use by the Customer. Customer shall not permit any person who is not legally qualified, to use equipment.

27. STOLEN PROPERTY. The Customer agrees to pay for rental equipment at its Replacement Cost after all types of

theft or disappearance. If the rented equipment is not returned to Grand Event Rentals within two days of date specified on the face of this contract, such equipment shall be considered stolen. In such event, Customer may be prosecuted in accordance with RCW 9.45.062 and/or 9A-56-030-050, or in accordance with any other Washington Criminal Laws that may apply.

28. COLLECTION COSTS. The Customer agrees to pay all reasonable collection, attorneys, and court fees and other expenses involved in the collection of charges or enforcement of Grand Event Rentals rights under this contract.

29. DAMAGE WAIVER TERMS. Each rental contract offers a damage waiver for an additional charge to cover your

responsibility for the damage to the merchandise caused in the course of normal use. The Damage Waiver does not cover the repair or replacement costs of items that are misused, mishandled, or otherwise abused (example: a chair breaks when being used as a step-stool). Damage Waiver is 10% of the total rental and covers reasonable, accidental damage to the equipment incurred with normal use. It is optional and is non-refundable. If the damage waiver is declined and any rental items are damaged, the customer will be responsible for the replacement charges for the damaged items.

Replacement charges will be assessed on any equipment due to loss, theft, abuse, or intentional damage by the customer. Responsibility for equipment remains with customer from delivery until return. Please be sure equipment is secured when not in use and is protected from weather and irrigation/sprinkler equipment. Broken equipment must be returned in order for the Damage Waiver to apply.

 

Damage Waiver Covers:

Breakage: All equipment will be covered with return of broken items.

Damage: All equipment damaged through normal use such as table scratches, dishware chips, glassware cracks, etc.

Linens: Stains/soiling from food & drink caused by normal use.

Dish/Glass: With the return of the broken items.

Tents: All physical damage to tents due to hail, rain and wind (excluding snow accumulation) will be covered (excluding customer installed tents).

 

Damage Waiver Does NOT Cover:

Shortages/missing items.

Abuse, theft, vandalism or other dishonest act towards rental items

Items left out in rain or in sprinklers, causing water damage.

Mysterious disappearance, theft, conversion or other dishonest act on party of any person to persons to whom the rented equipment is entrusted or any person or persons in service or employment of the Lessee whether or not occurring during hours of such service or employment.

Linens: wax, burn holes, ink stains, tears, mildew and excessive soiling of linen that does not constitute normal use.

Tents: damage not caused by weather such as rips and tears from sharp implements, excessive tape, paint or any other human caused damages. Damage caused by excessive snow loads.

 

PLEASE NOTE: The Damage Waiver is NOT insurance. It is a waiver for potential damage charges and does not constitute insurance in any way. All policies apply to the time equipment in in your possession, defined as the time of delivery to the time of pick-up for delivered orders, or time of pick-up to time of return for will call orders.
